represented and whose costs I suppose will have to be paid by the

Government. A more serious difficulty however exists in the fact

that it is difficult to see exactly what form the Landais should

take; and I can only sugest that if these Mandaue proceedings are

authorized, an application in the first instance should be made to

Mr. Hazeland to carry out the terms of the Governor's requisition

according to lay and in the event of his refusal (which we may

anticipate) then to the Full Court asking for an order against him

calling upon him to hear and determine the matter according to law.

Of course one will be met with two arguments and two serious

arguments; the first of which is that this procedure forms a means of directly traversing the judicial discretion of the Magistrate which is not given under the law and secondly that the Magistrate

has already decided the case according to the best of his judg-

-ment.

With regard to (c) we are confronted with still greater difficulties; Mr. Hazeland is the Senior Magistrate and it can hardly be expected that if we apply to a Junior Eagistrate, such Junier Magistrate will disagree with his Senior colleague; even to apply to another Magistrate would give the proceedings the air of persecution and if another Magistrate decided differently from Mr. Hazeland, it would probably be said that the Government had instructed him as to the decision which he should give; whilst to appoint a Special Magistrate for this particular case would again give rise to even more unfavourable comment. It is however perhaps even doubtful whether if application was made to another Magistrate it might not successfully be pleaded that the matter had already been disposed of.

From the above observations you will see that I am at a loss to suggest any other course save that of the Mandamus and even in that course I feel no very great confidence; the difficulty being firstly to persuade the Full Court to give a decision on an academic point which the order for their mandamus if granted could hardly specifically refer to. In other words unless one could devise some form of order under which the Full Court would call
